Commercial vs Residential Title: What It Means When You Buy a Condo in Malaysia

On this page
A serviced apartment on commercial land and a condominium on residential land can look the same from the street. The difference is a condition written on the land title. In Selangor it has changed how the water is billed. Assessment tax and quit rent depend on your council and your state. So read the land title line before you fall for a floor plan.
Where the title comes from
Under the National Land Code, land in Peninsular Malaysia sits in one of three categories: agriculture, building or industry. Homes and shops both come under “building”. What makes a plot residential or commercial is the express condition on its own title, which says what the land may be used for. An owner who wants a different use has to apply to change it. Sabah and Sarawak have their own land laws.
Does the housing law still protect you?
It can. A serviced apartment on commercial land can be sold under the HDA, the main law protecting people who buy homes still being built. On this site, dozens of the projects we list are on commercial land and marked as sold under the HDA. Not every one is, and even in one tower some units can be sold outside the HDA. The land title line on a project page is a first hint. Your own sale and purchase agreement is what counts. Our HDA guide explains what that law gives you.
The name on the brochure doesn’t tell you the title. A project sold as a serviced apartment can still sit on residential land.
What can differ on a commercial title
Water, in Selangor. This is the clearest case on record. Air Selangor has billed serviced apartments on commercial land through one bulk meter (a single meter for the whole building), at commercial rates, and the management splits the bill between units. Condos and apartments on residential land have been eligible to move to their own meters at the lower home rate since 2008. In June 2025, Air Selangor got approval to also let homes in commercial-titled buildings move to their own meters. Other states have their own water operators, and we have not checked their rules.
Assessment tax. This is the tax your local council charges on your unit. Each council sets its own rates by category, and the Local Government Act lets it charge different rates by how a property is actually used. So whether a commercial title costs you more depends on the council.
Quit rent. In Peninsular Malaysia, this is a yearly charge on the land, paid to the state. Each state sets and revises its own rates. It falls due on 1 January and is late from 1 June. For a strata unit, ask how it is billed to you.
Electricity. We could not find an official rule that ties your electricity tariff (the price scale you are billed on) to the land title. Ask the developer which tariff the building will use, and get it in writing.
What is the same
The Strata Management Act 2013 (the law for buildings split into separately owned units) does not treat residential and commercial titles differently. Either way, you pay maintenance charges plus a sinking fund (savings for big future repairs) of at least 10% of those charges.
Same area, two titles
One area can have both: a condominium on residential land, and a serviced apartment on commercial land sold under the HDA. Check the land title line on each project page before you compare prices. In Selangor, also ask each developer whether units get their own water meter.
What to check before you buy
- What does the land title say: commercial or residential?
- Is the sale under the HDA? Your sale and purchase agreement should say so.
- Will your unit have its own water meter, and at which rate?
- Which electricity tariff will the building use?
- What assessment rate does the local council charge for this kind of unit?
- Does your bank treat a commercial-titled home any differently for the loan?
- If you are a first-time buyer, is this unit a type that qualifies for the stamp duty exemption? See our stamp duty guide.
This is a general guide, not legal advice, and rules and rates can change. Check your own case with your lawyer, your council and the developer.
Frequently Asked Questions
What is a commercial title for a condo?
In Peninsular Malaysia, land for homes and shops sits in the same "building" category. What makes a plot residential or commercial is the condition written on its own title, which says what the land may be used for. On this site, most serviced apartments stand on land approved for commercial use.
Can a serviced apartment on commercial land be sold under the HDA?
Yes, and many are. Dozens of the projects we list are on commercial land and marked as sold under the HDA, the main law protecting people who buy homes still being built. Not every one is, though. Check that your own sale and purchase agreement says HDA.
Do I pay commercial water rates in a serviced apartment?
In Selangor, Air Selangor has billed serviced apartments on commercial land through one bulk meter (a single meter for the whole building) at commercial rates. In June 2025 it got approval to let homes in such buildings move to their own meters. Other states have their own water operators, and we have not checked their rules.
Is assessment tax higher on a commercial title?
It depends on your local council. Each council sets its own assessment rates, and the law lets it charge different rates by how a property is actually used. There is no single national answer, so ask the council or the developer for the expected rate.
Does the land title decide whether I get the first-home stamp duty exemption?
Not the title itself. The exemption depends on the type of home. A house, condominium unit, apartment or flat can qualify, but serviced apartments, SOHOs, SOFOs and SOVOs (small office-style units) are left out. Our stamp duty guide explains the full rules.
